William Ainger, John Walker, ) children of "said" Seth

Charles Paine now deceased
was a son of Frances Paine
& Seth Paine, living at the time of the execution of said deed of
trust, departing this life in the month of September 1865, leaving
him surviving Phimelia Paine, his widow and an infant child named
Minne Paine "now" of tender years, his sole heirs at law and
personal representatives.
That Frances Paine, the mother of said Complainants died on
or about the month of April 1858 intestate leaving children her
surviving issues of her marriage with Seth Paine, Seth Paine Jr.
William Paine, complainants herein, Fanny Paine, Lizzie Paine &
Charles Paine since deceased. That at the time of the death of
their mother, complainants and the said Fannie Paine & Lizzie Paine
their sisters were of tender years, unable to contribute to their
own support in any degree.
That the real estate mentioned and set forth in said deed of
Trust is farming land situated in Lake County, Illinois, a large
portion of which is wholly unimproved, that they were compelled
to and did rent the said premises to tenants to work the said farm;
that they have not been able to rent the said premises for an
amount sufficient to pay the taxes and assessments which have been
levied & assessed upon said real estate since the making and execution
of said Deed of Trust and keep the same in repair &c. without the

power of the said heirs & children of said Frances Paine to
prevent the same.- That said realestate has at all times since
the making & execution of said Trust Deed has been & now is a
burden upon said children rather than a benefit as contemplated
by said Deed of Trust.
That said Timothy R. Young the Trustee in said deed named has
long since resigned his said Trust and now wholly neglects and
refuses to execute and perform the duties thereof in any way
or manner.
That sometime in 1856 or 1857 the Timothy R. Young in
writing under his hand directed to the Hon. George Manierre, then
Judge of the 7th Judicial Circuit of the State of Illinois resigned
his said Trust and declined the further execution thereof, that
thereupon and in the life time of the said Francis Paine and at
her special instance and request the said Judge Mannierre sitting
in chambers did accept said resignation of said Timothy R. Young
and did appoint in his place & stead as such Trustee Seth Paine
the husband of said Frances Paine and the father of Complainants,
who accepted said Trust and entered upon the duties thereof and
from thence until the "present time" acted as such Trustee under
said deed with intent and purpose to carry into effect the true
intent and meaning thereof faithfully in all things.
That no record of the resignation or refusal to act of the
said Timothy R. Young or of the appointment of the said Seth Paine
as his successor or substitute appears of record in the County of
Lake aforesaid in the Court of Chancery thereof although in truth
and in fact such appointment was made in due form of law and should
have been entered of record in said Court, and the omission to enter
the same was not at the procurement or by or with the knowledge
or consent of Complainants, or of any one acting for them in this
behalf. That after the resignation of Timothy R. Young as Trustee
and the appointment of Seth Paine as successor in Trust, and in
the life time of the said Frances Paine and at her instance, and
request, and for the purpose and with the intent of carrying out
the object of said Trust and to support and provide for the said
Frances Paine, and her children, as also to pay taxes upon said
estate &c. did from time to time sell and convey a part of the
14.
lands in said Deed of Trust mentioned and described to one John
Robertson and did accept & receive from said Robertson full
payment in money therefor.- That the lands so conveyed to said
Robertson are described as follows, viz: The North West quarter
of the North West quarter of Section 17, the North East quarter
of the North East quarter of Section 18, ten acres off of the West
side of the South East quarter of the North East quarter of Sec.
18; Five acres off of West part of North East quarter of the
South East quarter of Section 18, all in Township 43 North of Range
10 East of the 3d P. M. which said lands were conveyed by deed
dated Sept. 29, 1860 and recorded in Vol. 32 of Deeds, page 163,
(shown in No. preceding). That the sale of said lands to said
Robertson by said Seth Paine were necessary and proper acts, and
that the Court ought in justice and equity to confirm the title
thereof and thereto in the said John Robertson.
That the title to a portion of the land mentioned in said
Deed of Trust is encumbered & clouded of record although in truth
and in fact no incumbrance or cloud should or ought to be thereon
in equity. That on or about March 13, 1849 the said Seth Paine
& Frances Paine his wife, for the purpose of aiding in the estab-
lishment of a community at Lake Zurich, Lake County, Illinois, on
the principles of equal rights and universal brotherhood and with
the express understanding & agreement & condition that the cause
should be established upon the lands in said Deed described, did
convey by special deed of Warranty to David Harrower, John Wilson,
Andrew McKinzie, John Powell, George Young, Robert Miller, Alexander
B. Cummings, Alexander Drysdale, William Anger, John
& Seth Paine, the West 1/5 of the North East quarter of South East
quarter of Section 18, also West 10 acres of South East quarter
of North East quarter of Section 18, the North East quarter of
North East quarter of Section 18, the North West quarter of the
North West quarter of Section 17, (with other land) all in
Township 43 North of Range 10 E. of the 3d P. M.
That the whole and only object intent and consideration of
the making of said conveyance was that said community should be
formed &c. and located on the lands conveyed and in said deed
15.
described. That said Paine & wife executed said conveyance and
caused the same to be recorded at their own motion without the
knowledge or acceptance of the greater portion of the grantees
in said deed named. That no money whatever or other valuable con-
sideration was paid to said Paine for said conveyance.
That said enterprise was abandoned and that at or about the
time of the abandonment of said enterprise the said grantees
in said Deed named did reconvey unto the said Seth Paine by a
quit claim deed by them executed and acknowledged in due form of
law all the said land so conveyed to them for the purposes afore-
said and did deliver the said reconveyance so executed to the
said Seth Paine.- That said Seth Paine neglected to place said
quit claim deed of reconveyance of said land from David Harrower
& his associates to him, said Seth Paine upon the records of land
titles in said Lake County and that said deedhas never been record-
ed and is now lost or mislaid so that the same cannot now be
found.

George & John H. Coffing (shown as No. hereof) and that the
indebtedness secured by said Mortgage has been fully paid, satis-
fied and discharged more than 15 years previous to the filing of
